MentalEmails.com Terms Of Service By signing up and actively using the MentalEmails.com program you agree to all terms and conditions set forth in this agreement. MentalEmails.com may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with MentalEmails.com. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the MentalEmails.com program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change. Updated October 26, 2006: Changes/additions to the terms will be noted in brown text. Responsibility of Members: You must be 13 years of age or older to participate in this program. Our program is open to both US and International members and is void where prohibited by local governing laws. You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing MentalEmails.com account. You will use your email address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link. You are solely responsible for any and all use of your MentalEmails.com account including authorization by you to any third party individual who may use your account. Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by MentalEmails.com be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination. You must maintain a valid e-mail account that will be used with MentalEmails.com. You agree to receive e-mail advertising from MentalEmails.com. In the event your e-mail account on file becomes closed or blocked to messages from MentalEmails.com, your account will be suspended. We reserve the right to set your account to "Inbox Only" in the event you have excessive bouncing emails. It is your responsiblity to ensure that you can receive emails from mentalemails.com. Many email accounts block mass mails, or place them in spam folders. Gmail accounts are free and very user friendly for ptr accounts. Any member sending us gibberish will result in automatic termination of account and forfeiture of all earnings to date of termination. Auto-responses will also be deleted immediately. You must sign up with legitimate information. You must have a real name, and address from the country where you live. If you live in a foreign country, and sign up with a US address, your account will be deleted, and you will be banned from joining in the future. You must fill out the payment information if you expect to be paid. If you want to be paid via paypal, it must include you PayPal address. If you choose e-gold, you must include an E-gold number. Relationship of the Parties: You and MentalEmails.com are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and MentalEmails.com. You understand that you do not have authority to make or accept any offers or make any representations on behalf of MentalEmails.com. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program. Limitation of Liability: MentalEmails.com will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or MentalEmails.com program, even if MentalEmails.com has been advised of the possibility of such damages. Furthermore, MentalEmails.com aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. Payments: Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by MentalEmails.com. Members may earn by referring new members to the MentalEmails.com program. Members will earn a percentage of advertising revenues collected by MentalEmails.com. Members will be paid via PayPal / eGold. MentalEmails.com will pay members when their balance reaches the minimum payout of $3.75. Once the member has reached payout they may request payment. Payments will be made within 30 days or a reasonable time after. Egold is harder to keep funded and will be paid when funds are available. Spam: You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with MentalEmails.com and may result in legal prosecution. MentalEmails.com strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. MentalEmails.com may charge up to $5 per spam email sent. Multiple Signups Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. No two members may use the same payment id. "We send out links between $0.00035 and $0.01. On rare occasion, you may receive a link in a value higher than the maximum stated, but in those instances, the link will be clearly marked. We are human just as we hope you are, and should there be a link valued above the maximum or below the minimum due to script or human error, we reserve the right to adjust your earnings for the difference between the correct amount and the erroneous link. Should you click on one of these rare, error links and attempt to cash out because of the error, your account will be terminated and not be reinstated." Suspending/Terminating Accounts: Members must click on at least one paid tracking link per 30 days in order to remain active in our program. Failure to do so will have your account suspended. Members signing up from the same computer will have their account terminated. Members signing up with false information, including but not limited to stating they are from one country, while their ip address states another will have their account terminated. English Tests: Members are expected to be able to read and understand the English language. There will be periodic tests performed via the administration messaging system with simple questions and multiple choice answers. Failing 3 of these test will get your account terminated. Cheat Links: We include cheat links in our emails and/or cheat banners in our ptc area. Excessive clicking of these links will get your account terminated. Turing Numbers: We reserve the right to occassionally turn on turing numbers to monitor cheat bot software usage. Clicking the wrong turing numbers frequently will get your account terminated. Vacation Time: You can set your account on vacation for up to 30 days. If more than 30 days is needed contact us. Accounts with no activity 5 days past vacation end date will be considered inactive. We reserve the right to suspend any account for any type of suspected cheating including, but not limited to, items set forth in these terms. If your account becomes suspended you may use the contact form on the site to request that your account be reinstated. All suspended and terminated accounts are purged from our system every 60 days. Once an account is purged from the system, all information from your account is gone forever and cannot be recovered under any circumstances. Advertising/Redemption Terms: Sites must be in English or have a visible link for an English version of the site. **Email Ads for sites primarily in French or Spanish may be accepted when accompanied by     an English text ad and if targeted to members who chose to view sites in these languages. **All languages will be considered for rotating banner ads and money maker links. We reserve the right to reject any ad that we do not feel is appropriate for general audiences. No sites with 0 iframes. We reserve the right to do minor editing for typing, spelling or grammar errors. We do not accept ads that have any reference to the word "cheat". Such as "not a cheat link". Since we do send emails with cheat links we feel this is misleading and confusing to our members. If a site that you have advertised goes offline we reserve the right to "pause" the ad. If the site returns, we will "unpause" your ad. You may contact us if the site returns, if we don't notice it first. You have the right to change your ad at any time by either using the contact form or for a quicker response you may use our support forum. We are not responsible for any claims, implied or actual, made by advertisers in their ads. Advertisers are responsible for all claims made in their ads.
